Competition terms and conditions
IMPORTANT NOTICE
This prize draw is open only to professional clients, eligible counterparties or eligible contract participants (as defined below) attending a qualifying corporate event.
Participation constitutes acceptance of these Terms and Conditions in full.
Definitions and Interpretation
In these Terms and Conditions, the following words and expressions shall have the meanings set out below:
- “Competition”
- means the prize draw described in these Terms and Conditions.
- “Eligible Contract Participant”
- means a person or entity that meets the definition of an “eligible contract participant” as that term is understood under applicable US commodities legislation, or such equivalent category as may be recognised under any other applicable law.
- “Eligible Counterparty”
- means a person or entity classified as an eligible counterparty within the meaning of Chapter 6 of the Financial Conduct Authority’s (FCA) Conduct of Business Sourcebook (COBS) or such successor provisions as may be in force from time to time.
- “Entrant”
- means an individual who submits a valid Entry in accordance with these Terms and Conditions.
- “Entry”
- means a completed and valid submission of an Entrant’s personal details via the online entry form as described in Clause 5.
- “Event”
- means the corporate or online event hosted by the Promoter at which this Competition is offered, details of which will be communicated to attendees directly.
- “Entry Period”
- means the period during which Entries may be submitted, as specified by the Promoter at the Event.
- “MillTech”
- means Millennium Global Treasury Services Limited and its affiliates.
- “Prize”
- means the prize awarded to the Winner, details of which will be announced by the Promoter at or prior to the Event.
- “Professional Client”
- means a person or entity classified as a professional client within the meaning of Chapter 3 of the FCA’s Conduct of Business Sourcebook (COBS) or such successor provisions as may be in force from time to time.
- “Promoter”
- means MillTech.
- “Winner”
- means the Entrant selected in the Random Draw as the recipient of the Prize.
- “Random Draw”
- means the process by which the Winner is selected at random from all valid Entries received during the Entry Period, as described in Clause 7.
References to statutory provisions include those provisions as amended, re-enacted or replaced from time to time. Headings are for convenience only and shall not affect interpretation.
The Promoter
The Competition is organised and promoted by the Promoter. Queries relating to this Competition should be directed to the Promoter’s representative present at the Event or via the contact details provided at the Event.
The Promoter’s decision is final and binding in all matters relating to this Competition, including but not limited to questions of eligibility, validity of Entries and selection of the Winner. No correspondence will be entered into.
Eligibility
The Competition is open exclusively to individuals who, at the date of Entry, satisfy all of the following conditions:
- they are aged 18 years or over;
- they are an employee, officer, director, partner, or authorised representative of a firm or entity that has been classified by the Promoter as a Professional Client, an Eligible Counterparty, or an Eligible Contract Participant;
- they are attending the Event in their professional capacity as a representative of such a firm or entity; and
- they have submitted a valid Entry in accordance with Clause 5.
Employees, officers, directors, contractors, and immediate family members of employees of MillTech are not eligible to enter.
Entry into the Competition constitutes the Entrant’s warranty and representation that they meet all applicable eligibility criteria. The Promoter reserves the right to verify eligibility at any stage and to disqualify any Entrant who does not satisfy the requirements set out in these Terms and Conditions.
For the avoidance of doubt, retail clients (as defined by the FCA) are not eligible to participate in this Competition.
Entry Period
Entries will only be accepted during the Entry Period as communicated by the Promoter at the Event. Entries received before the commencement or after the close of the Entry Period will be void and will not be considered.
The Promoter reserves the right to extend or shorten the Entry Period at its discretion, provided that any such change is communicated to potential Entrants at the Event.
How to Enter
To enter the Competition, eligible individuals must complete the online entry form (“Entry Form”) made available by the Promoter at the Event. The Entry Form will require the Entrant to provide, as a minimum, the following personal details:
- full name;
- job title;
- employer / organisation name;
- business email address / business phone number (optional); and
- any other information reasonably requested by the Promoter on the Entry Form.
Only one Entry per individual is permitted. Multiple Entries from the same individual will be discarded and only the first valid Entry received will be considered.
Entries must be submitted via the online Entry Form only. No other method of entry (including paper, email, telephone, or social media) will be accepted.
Incomplete, inaccurate, or illegible Entries will be considered invalid. The Promoter accepts no responsibility for Entries that are not received for any reason, including but not limited to technical failures, network errors, or server downtime.
By submitting an Entry, each Entrant agrees to be bound by these Terms and Conditions and confirms that all information provided is accurate, complete, and up to date.
There is no purchase necessary to enter this Competition and no fee is payable by any Entrant.
The Prize
The Prize will be as announced by the Promoter at or prior to the Event. Details of the Prize will be made available to attendees at the Event.
The Prize is non-transferable, non-negotiable, and cannot be exchanged for cash or any other alternative. No cash equivalent will be offered.
The Promoter reserves the right to substitute the Prize with an alternative prize of equal or greater value in the event that the original Prize becomes unavailable for any reason beyond the Promoter’s control.
The Winner is solely responsible for any tax, import duties, travel costs, or other expenses incurred in connection with acceptance of the Prize that are not expressly included as part of the Prize.
Winner Selection and Notification
The Winner will be selected by means of a Random Draw from all valid Entries received during the Entry Period. The Random Draw will be conducted by or on behalf of the Promoter as soon as reasonably practicable following the close of the Entry Period, and where possible at or shortly after the Event.
The Random Draw will be conducted using a fair and transparent process. All valid Entries will have an equal probability of being selected.
The Promoter will make reasonable efforts to contact the Winner using the contact details provided in the Entry Form within five (5) working days of the Random Draw. If the Winner cannot be contacted, fails to respond within ten (10) working days of the initial notification, or is found to be ineligible, the Promoter reserves the right to conduct a further Random Draw to select an alternative Winner from the remaining valid Entries.
The Winner may be required to provide proof of identity and eligibility before the Prize is awarded. The Promoter reserves the right to withhold the Prize until such verification is satisfactorily completed.
The name of the Winner may be made available on request by writing to the Promoter within one (1) month of the Event. Where provided, only the Winner’s first name and the initial of their surname will be disclosed.
General Conditions
The Promoter reserves the right to cancel, suspend, withdraw, or amend this Competition or these Terms and Conditions at any time, at its absolute discretion, without prior notice, where circumstances make this necessary.
The Promoter will not be liable for any failure to perform its obligations under these Terms and Conditions where such failure is due to circumstances beyond its reasonable control, including but not limited to acts of God, pandemic, civil unrest, or technical failure.
The Promoter accepts no responsibility for any damage, loss, liabilities, injury, or disappointment incurred or suffered by any Entrant arising from their participation in this Competition or acceptance of any Prize.
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, it shall be severed from the remainder, which shall continue in full force and effect.
This Competition does not form part of any contractual relationship between the Promoter and any Entrant or their employer. Nothing in these Terms and Conditions shall be construed as creating any form of financial promotion, investment advice, or regulated activity within the meaning of the Financial Services and Markets Act 2000.
Data Protection and Privacy
By submitting an Entry, each Entrant acknowledges and agrees that their personal data will be processed by the Promoter for the purposes of administering the Competition, including verifying eligibility, conducting the Random Draw, and contacting the Winner.
The Promoter will process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018, and its privacy policy, a copy of which is available on the Promoter’s website.
Personal data provided in connection with this Competition will not be used for marketing purposes without the Entrant’s separate and express consent, and will be retained only for as long as is necessary for the purposes described above, or as otherwise required by law.
Entrants have the right to request access to, correction, or deletion of their personal data at any time by contacting the Promoter’s Data Protection Officer using the contact details provided at the Event or on the Promoter’s website.
Governing Law and Jurisdiction
These Terms and Conditions and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.
Each party irrevocably submits to the exclusive jurisdiction of the courts of England and Wales to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
